Terms of Service & Privacy Policy
Kuest, Inc.
Delaware, United States
Effective Date: October 14, 2026
One place for the rules governing Kuest's websites and infrastructure, and for how Kuest, Inc. handles personal information. Kuest is the infrastructure provider; independent operators remain responsible for the sites and services they run.
Part 1 โ Terms of Service
These Terms of Service ("Terms") form an agreement between you and Kuest, Inc. ("Kuest," "we," "us," or "our") concerning the Kuest websites, interfaces, APIs, developer tools and infrastructure services described below.
Important: Prediction markets, cryptocurrency and smart-contract transactions involve significant risk, including the possibility of losing your entire position. Access to Kuest technology does not establish that trading is legal in your jurisdiction or that any operator holds a regulatory license.
1. Scope and Acceptance
These Terms apply when you visit or use Kuest-controlled websites (including kuest.com and Kuest-branded demonstrations), obtain access to Kuest-hosted technology or APIs, or use Kuest-provided infrastructure as an operator, developer or participant. By accessing or using the applicable services, you agree to these Terms. If you act for an organization, you represent that you are authorized to bind it.
An independently operated prediction market using Kuest infrastructure (an "Operator Site") may have separate terms and a separate privacy policy. Those documents govern the operator's relationship with its users. These Terms govern the Kuest-provided components to the extent applicable and do not replace an operator's legal obligations. A separately signed commercial agreement with Kuest prevails over these Terms to the extent of a conflict.
2. What Kuest Provides
Kuest develops and makes available white-label prediction-market technology, which may include software, APIs, market-data services, authentication support, order-book and matching infrastructure, transaction relaying, market creation and resolution integrations, shared liquidity and connections to blockchain networks. Availability and functionality vary by deployment and may change over time.
Operators may configure their own brands, domains, markets, frontends, deployment environments and certain fees. Markets or orders can be shared across compatible operator interfaces; use of an Operator Site does not imply a private or exclusive order book. Kuest does not guarantee liquidity, execution, pricing, market availability, outcomes or any particular performance.
3. Operators and Regulatory Responsibility
Each operator is independently responsible for its website, branding, customer relationship, market selection and content, marketing, user-facing disclosures, customer support, applicable taxes, and the systems and data under its control. Operators must determine and comply with all laws and requirements applicable to their business and users, including, where applicable, gaming, financial services, derivatives, consumer protection, age restrictions, anti-money-laundering, sanctions, identity verification and data protection rules.
Operators must implement and maintain any required licenses, approvals, geographic restrictions, onboarding checks, privacy notices, consent mechanisms and risk warnings. Providing geoblocking or identity-verification integrations does not mean Kuest undertakes the operator's compliance responsibilities or guarantees their adequacy. Kuest remains responsible for obligations imposed on Kuest by applicable law and for commitments Kuest expressly makes in an applicable agreement.
An operator must not misrepresent its licensing, imply Kuest has approved its regulatory status, modify core trading behavior in violation of applicable software terms, or use Kuest infrastructure for unlawful activity. Separate enterprise, independent-stack or managed-service arrangements may require a written commercial agreement.
4. Eligibility, Accounts and Wallets
Trading-related features may only be used by persons who are at least 18 years old (or the higher age required by local law), are legally eligible to participate and are not barred by applicable law, sanctions or geographic restrictions. You must not circumvent access restrictions, including through VPNs or false location information. We or an operator may require additional eligibility checks or refuse access when necessary.
You are responsible for your account, credentials, wallet security, signatures and authorized actions. Certain features may use self-hosted wallets, smart-contract wallets or deposit-wallet arrangements. The specific custody, authorization and transaction mechanics depend on the product and integration used; do not assume that every wallet feature operates in the same manner. Blockchain transactions may be irreversible, and network fees may be non-refundable.
5. Markets, Orders, Settlement and Fees
Market questions, order books, prices, probabilities and reference data may originate with operators or third parties. Displayed prices are not guarantees or professional advice. Orders may be matched through shared Kuest infrastructure, including against orders originating from other participating sites or permitted automated trading tools. Execution depends on market conditions, technical availability and applicable restrictions.
Each market is subject to its published rules and any applicable oracle, proposer, challenge or dispute process. Results, disputes, delays and settlement may depend on smart contracts or external services. Kuest does not guarantee a particular market resolution or assume responsibility for an operator's misleading market descriptions.
Trading, creator, maker, operator, affiliate, network or infrastructure fees may apply, depending on the feature and its current configuration. Fees and revenue allocations may be calculated by category, order details and applicable settings, and may be distributed between Kuest, operators and affiliates. The amounts displayed in the relevant interface, transaction confirmation, published technical documentation or applicable written agreement govern; no fixed fee rate or revenue allocation is promised by these Terms. Operators are responsible for understanding their configuration before offering services to users.
6. Paid Services and Commercial Arrangements
Free demonstrations, guided launches, usage-based features, production access and enterprise services may have different conditions. Any applicable prices, payment timing, credits, refund terms, service commitments, fee-sharing terms or deployment permissions are specified at checkout, in the relevant product configuration or in a separate agreement. A free launch does not promise free production infrastructure or ongoing service indefinitely. We may change prospective pricing with appropriate notice where required by law or contract.
7. Software License, Intellectual Property and Content
The public Kuest code repository is subject to the license included with that repository, including its additional restrictions. These Terms neither replace that license nor grant rights beyond it. Hosted Kuest services, non-public software, trademarks and other materials remain owned by Kuest or the respective rights holders, except where expressly licensed.
You retain the rights you have in lawful content you submit. You grant Kuest a non-exclusive license to host, reproduce, transmit and process that content only as reasonably necessary to provide, secure, support and improve the services, or as otherwise authorized by you. You are responsible for ensuring that your content does not infringe third-party rights. Suggestions and feedback may be used by Kuest without compensation or obligation.
8. Acceptable Use
You may not use Kuest services to violate laws or sanctions, facilitate prohibited transactions, deceive users, infringe intellectual property, interfere with systems, obtain unauthorized access, introduce malicious code, or engage in market manipulation, including spoofing, wash trading or fraudulent orders. Bots and programmatic access are permitted only through authorized interfaces and within applicable technical, contractual and market-conduct rules.
9. Third Parties and Technical Risks
Kuest services may rely on Polygon or other blockchains, smart contracts, oracles, bridges, RPC providers, market-data providers, wallet systems, identity-verification providers and cloud infrastructure. Such systems may fail, be delayed, be attacked, change rules or become unavailable. Smart-contract audits, where applicable, do not eliminate risk. You should independently evaluate these risks and never commit funds you cannot afford to lose.
Nothing provided by Kuest constitutes investment, trading, legal or tax advice, or a guarantee of regulatory treatment. References to third-party markets, providers or brands do not imply endorsement or affiliation unless expressly stated.
10. Changes, Suspension and Termination
We may update, restrict, suspend or discontinue services or access to protect users, address security or legal issues, enforce these Terms or maintain the platform. Where reasonably practical, we will provide notice of material changes affecting paid services, subject to urgent circumstances and contractual obligations. Access restrictions do not necessarily reverse on-chain actions or recover previously transferred assets.
We may revise these Terms by publishing an updated version and effective date. Where required, we will give additional notice or obtain fresh agreement. Continued use after changes become effective constitutes acceptance only to the extent permitted by applicable law.
11. Disclaimers and Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED OPERATION, ERROR-FREE PERFORMANCE OR PARTICULAR TRADING RESULTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KUEST AND ITS OFFICERS, PERSONNEL AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUES OR DATA. KUEST'S TOTAL LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID DIRECTLY TO KUEST FOR THE RELEVANT SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
This limitation does not exclude liabilities that cannot legally be limited, and it is subject to any different allocation expressly agreed in a signed commercial contract. Nothing in these Terms removes non-waivable statutory rights.
12. Indemnification
To the extent permitted by applicable law, you agree to defend and indemnify Kuest against third-party claims, damages and reasonable expenses arising from your unlawful conduct, breach of these Terms, infringing content or operation of an Operator Site, except to the extent caused by Kuest's own breach, unlawful conduct or fault. This section is subject to any different indemnity terms in a written commercial agreement.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles, subject to any mandatory laws that apply to you. Before filing a formal claim, contact hello@kuest.com with a description of the dispute and allow 30 days for a good-faith attempt to resolve it.
Except where prohibited by applicable law, disputes not resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable rules, with remote participation permitted where available. The U.S. Federal Arbitration Act governs this arbitration provision where applicable. Claims eligible for small-claims court, requests for urgent injunctive relief, and claims that applicable law requires to be heard in court are excluded from mandatory arbitration. To the extent permitted by law, claims must be brought individually rather than as a class or representative action. If arbitration is not available or enforceable, the competent state or federal courts in Delaware will have jurisdiction, subject to mandatory venue rights.
14. General Provisions
If any provision is unenforceable, the rest remains in effect. Failure to enforce a right is not a waiver. These Terms do not create a partnership, agency, fiduciary or employment relationship between you and Kuest. You may not transfer contractual rights without our consent, except as required by law. Provisions intended to survive termination, including liability, intellectual property, indemnity and dispute terms, will survive to the extent applicable.
Part 2 โ Privacy Policy
This Privacy Policy explains how Kuest, Inc. handles personal information in connection with the Kuest-controlled websites, support channels, developer tools, APIs and infrastructure it operates.
1. Kuest and Independent Operators
Kuest determines the purposes and means of processing information for its own websites, business contacts, security operations and certain shared platform functions. An Operator Site is separately operated and may independently determine how user registration records, local databases, analytics, marketing and uploaded content are handled. For some operator-related data, Kuest may act as a service provider or processor on an operator's instructions; for other data, including security and compliance information, Kuest may have its own responsibilities.
If you use a prediction market with a third party's domain or brand, review that operator's privacy policy as well. This Policy does not replace notices required from independent operators.
2. Information We Collect
- Contact and business details: names, email addresses, business affiliation, inquiry details, support messages and information submitted during onboarding or commercial discussions.
- Technical and usage information: IP addresses, approximate location derived from IP, browser and device characteristics, session identifiers, log records, pages visited, service requests, security events and diagnostic information.
- Wallet and trading-related data: public wallet addresses, transaction identifiers, order-related records, signatures or authorization metadata and publicly available blockchain activity when relevant to services you use.
- Operator and developer information: service configuration, API credentials or identifiers, domain and deployment information, administrative actions, fee-wallet addresses and integration metadata.
- Verification information: eligibility, sanctions-screening or identity-verification status and related records if a compliance or KYC feature is enabled. Identity documents may be processed by a designated verification provider subject to the applicable disclosures.
- Optional content: market descriptions, reports, user submissions, feedback or other content supplied to Kuest-controlled systems or shared with Kuest by authorized integrations.
Not every category is collected from every person. The data processed depends on the services, configuration and operator involved. Some information comes directly from you, some is gathered automatically, and some comes from operators, service providers or public blockchain networks.
3. Why and on What Basis We Use Information
We use information to operate and support our services; connect wallets and accounts; authenticate requests; maintain trading and market infrastructure; provide customer support; manage commercial relationships; prevent fraud, abuse and security incidents; meet legal and compliance obligations; analyze reliability and improve services; and communicate material service or policy updates.
Where a law requires a specific legal basis, processing may rely, as appropriate, on performance of a contract, compliance with legal obligations, legitimate interests in security and operating our business, or consent. You may withdraw consent where processing depends on it, subject to applicable limitations. Marketing communications, where sent, will include an available unsubscribe or opt-out method.
4. Sharing and International Processing
We may disclose necessary information to hosting, infrastructure, monitoring, security, payment, communications, wallet, identity-verification, analytics and other service providers; to an operator responsible for your site or transaction; to professional advisers; or to authorities when required by law. Information may also be transferred as part of a merger, financing or sale of business, subject to applicable protections.
Blockchain addresses, transactions and smart-contract interactions submitted to a public blockchain may be visible to anyone and are generally not controlled or erasable by Kuest. Some order or market information may be available to network participants, including other operators, through shared-liquidity services as necessary for their operation.
We and our providers may process information in the United States and other countries. When legally required, we use applicable measures for international transfers. We do not sell personal profiles as part of our core infrastructure services. If we engage in a sale, sharing or targeted advertising activity regulated by applicable privacy law, we will provide the required additional disclosures and choices.
5. Cookies, Analytics and Tracking Signals
Kuest-controlled websites and services may use cookies or comparable technologies for authentication, preferences, security, performance and analytics. Available cookie controls depend on the service and your browser. Where non-essential cookies require consent, we will seek it before using them. Third-party services or content embedded in a site may have their own tracking practices and policies.
We do not provide a universal response to legacy browser "Do Not Track" signals. Where applicable law requires us to recognize a supported opt-out preference signal or provide an opt-out from covered processing, we will do so. Independent operators may use additional cookies and analytics governed by their own notices.
6. Retention, Security and Children
We retain information only as long as reasonably necessary for the purposes described above, including service delivery, recordkeeping, security investigations, dispute resolution and legal obligations. Retention periods vary by record and may be affected by backup cycles and requirements applicable to operators or regulated activity. Information recorded on public blockchains may remain available indefinitely.
We use reasonable organizational and technical safeguards suited to the information and services involved; no internet service or blockchain system is completely secure. Kuest's trading-related services are not intended for persons under 18, and we do not knowingly solicit personal information from children for those features.
7. Your Privacy Choices and Rights
Depending on your location and applicable law, you may have rights to request access, correction, deletion, portability or restriction of your personal information, object to certain uses, withdraw consent, or opt out of qualifying sales, sharing or targeted advertising. You may submit a request to hello@kuest.com. We may need to verify your identity and will respond as applicable law requires. If we deny a request and you have an applicable appeal right, you may appeal by replying to our decision or emailing that address with "Privacy Appeal" in the subject.
If an independent operator controls the data you seek to change or delete, we may direct you to the operator or assist it as required. We cannot delete public blockchain entries or data held independently by third parties.
8. Updates and Contact
We may update this Policy to reflect product, legal or data-practice changes. We will publish the revised policy with an updated effective date and provide additional notice for material changes when required. Questions or complaints about Kuest privacy practices can be sent to the contact below.
